Vietnam War Part - 9

The Vietnam war was an interesting period that has interesting pieces with the war vs hippies and an antiwar movement. The Vietnam War book was requested by my cousin as it was an interesting period and the start of the war against the enemy. The Vietnam War was one of the longest wars in history, and one of the few that they lost with the United States being a rare country that has a plus 90%-win rate in wars. This Piece of writing on the Vietnam War includes first, second and third person sources.

Document # 1 U.S District Court, District of Columbia, 71 Civ. 1235

June 18, 1971

The Washington Post publicized a major article: which published the main parts of the Vietnam War’s secrets. This was the first time in 200 years that the United States successfully attacked the press – which was a major problem and went against the constitution. The case was included in the war effort and would be majorly damaged- if they successfully published the article - however freedom of the press is a typical pillar of the US’s founding principles and of the rights of a democracy. The total freedom of the press was supported by the judges as it was part of the First Amendment of the Constitution. The judge analyzed that publishing the article they analyzed that there were no major problems with it, however the freedom of the press was the much more important issue.

The document was based on a major decision – top secret – part of Vietnam Policy.  The USA was particularly angry about the policy being published because of the potential to injure the national defense - however- it was viewed as not damaging to national interest according to the judge.  The Appellate court of officials determined the present vitality.

The judge was very angry that the government successfully stopped the ability of the press to stop the publishing of the papers. It was against the constitutional scared principles that are important to everyone. The executive department was not able to show that the article was a major problem for United States troops or other workers.  The courts told the press during the court case, “democracy only works when people are informed” (Sheehan 680.) This is a great quote, is very informative and adds to the United States versus the Free Press which is a constant battle even for democracies.

Document #2 Decision of the U.S Court of Appeals. District of Columbia circuit, Docket No. 71-1478

The Washington Post’s newspaper was the target of a restraining order by the United States court and the district’s specific documents were highly top-secret information.  The U.S government filed for a theft of the documents, and it was the first case in over 200 years that this was a major issue. The foreign policy -that came with the files- from the newspaper sites to congress- was highly informative and included top secret information. The United States bar fought very hard to protect the newspaper however the United States was very aggressive as this was one of the least risk-reward scenarios as well as beneficial to their workers. The court banned the production of the Newspapers publishing the paper of several newspapers which was an attack on democracy.

 

The actual cases of the newspaper site to congress included the restraining order against the newspaper preventing them from using the newspaper. The District Court- specific documents included theft of documents and their classified information. The court’s opinion relies on prior restraint and their journalists included a small percentage of the individual which included their governments documents with the government. The blind record of our documents effectively included the mentions to congress and our nation’s military and diplomatic activities. They were accomplished and should be included in other instances and defended their foreign policy. They included the vast majority of work with the blanket and resulted in the publication of certain papers. They used the words that were included with the law – bar.

Oral argument:

The Post and the Time: “items filled by the post and the times I do not believe are marked “top secret”, but they are marked “In Camera” in the caption of the items. I repeat, all three have also filed regular briefs except not printed. Only the American Civil Liberties Union seemed to have the resources to produce the printed Brief for this occasion (Sheehan 688.)” Mr. Bickel and I went to law school under an earlier dispensation.  It includes the constitutional right of free speech and of the free press. Constitutional law involves the resolution of competing principles. The New York Times got the top-secret information and was able to successfully publish it with the copyright.

 

Analysis:

The “top secret” Vietnam Papers were very important in the studying of the Vietnam War: However, the government was extremely protective of these papers because it could expose the U.S as a fraud or deceptive war that the U. S’s public was already not happy about. The court supported the publication of these papers which were defended by the bar (LAW). The United States guarantees the first amendment’s free press which was critical and is a constitutional right 99.5 % of the time. The United States was in the process of losing the war and the papers could expose to the public: it was a fraudulent and deceptive war that was hurting America and American interests.
